Verification of unfair competition

Competition is a natural economic process – but only when it is fair. Therefore, the legislature has introduced solutions aimed at combating unfair competition. The definition of unfair
competition is included in the Act of 16 April 1993 on Combating Unfair Competition.

According to its provisions, an act of unfair competition is any action contrary to the law or good practice if it threatens or violates the interests of another entrepreneur or customer.
Examples of unfair competition include: misleading labels, such as a company logo or product origin, copying the appearance or features of a product, slandering competitors, disseminating false information, violating trade secrets, breaching contracts, and using dumping prices to eliminate rivals from the market – this practice is considered unfair and prohibited competition in Poland.
